 This Privacy Policy is a part of the Terms of Service for Empire Shopping Network LLC dba Shell Shock CBD (“Shell Shock CBD”). By using this website or Shell Shock CBD’s online store, you agree to be bound by and comply with this Privacy Policy and our Terms of Service. 

SECTION 1 – AGE RESTRICTIONS ON ACCESS AND PURCHASES

You must be at least 21 years old to access this site. If you are under 21 years old you are not permitted to use this website for any reason. In addition you must be of the legal age required by the jurisdiction you are in to purchase our products. It is your responsibility to know whether you are legally able to purchase our products.

SECTION 2 – WHAT INFORMATION DO WE GATHER AND WHAT DO WE DO WITH IT?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address and order history. We also use cookies, web beacons or other tools that collect information that make it easier for you to use our store and our site.

When you visit our site, some information is automatically collected. This may include information such as the Operating System (OS) running on your device, Internet Protocol (IP) address (which may be used to obtain your geolocation), access times, browser type, and language, and the website you visited before our site. We also collect information about how you use our website such as your interactions with our website and other user actions.

Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data through Empire Shopping Network’s public message boards, this information may be collected and used by others.

Email marketing: By providing us with your email address, you are giving us permission to send you emails about our store, new products, new brands under the Empire Shopping Network portfolio and other updates. You have the opportunity to unsubscribe from these emails at any time by clicking the “Unsubscribe” button included at the bottom of each email.

How Shell Shock CBD use’s your information: In general, we use the information we collect primarily to provide, maintain, protect and improve our current website and products and to develop new products and brands. We use personal information collected through our website as described below and described elsewhere in this Policy to:

  • Facilitate the creation of and securing of your account on our network;
  • Identify you as a user in our system;
  • Improve our products, site, and how we operate our business;
  • Understand and enhance your experience using our website and products;
  • Provide and deliver the products and services you request;
  • Respond to your comments or questions and for our support team to provide service about Shell Shock CBD and/or other brands within the Empire Shopping Network portfolio of brands;
  • Send you related information, including confirmations, invoices, technical notices, updates, security alerts and support and administrative messages;
  • Communicate with you about promotions, upcoming events, news about products and services offered by Shell Shock CBD, brands within the Empire Shopping Network portfolio of brands and our selected partners, and for other marketing purposes of Shell Shock CBD;
  • Link or combine your information with other information we get from third parties to help understand your needs and provide you with better service; and
  • Protect, investigate and deter against fraudulent, unauthorized or illegal activity.

Do Not Track. Some Internet browsers, such as Internet Explorer, Firefox, and Safari, include the ability to transmit “Do Not Track” or “DNT” signals. Since uniform standards for “DNT” signals have not been adopted, our site(s) does not currently process or respond to “DNT” signals.

SECTION 3 – CONSENT

How does Shell Shock CBD get your consent?

By providing Shell Shock CBD with personal information to complete a transaction, placing an order, arranging for a delivery or returning a purchase you are consenting to our collecting and using your information (your credit card information is discussed in Section 4 below).  

How do I withdraw my consent? 

You may withdraw your consent for us to contact you by clicking the “Unsubscribe” button included at the bottom of each email or contacting us at support@shellshockcbd.com.

Shell Shock CBD does not share your personal information with third parties without your consent other than with the following:

  • Third Party Service Providers. With third parties who work on our behalf, provided that such third parties provide at least the same level of privacy protection as required by this Privacy Policy;
  • Lawful Requests. To comply with laws or to respond to lawful requests and legal process (provided that we will endeavor to notify you at the address you have given us if we have received a lawful request for your information);
  • Protection of Rights and Property. To protect the rights and property of Empire Shopping Network, our agents, customers and others including to enforce our agreements, policies and terms included in this Privacy Policy or our Terms of Service;
  • Emergency. In an emergency, including to protect the personal safety of any person; and
  • Corporate Restructuring. For the purposes of a business deal (or negotiation of a business deal) involving a sale or transfer of all or a part of our business or assets (business deals may include, for example, any merger, financing, acquisition, divestiture or dissolution transaction or proceeding). In the event of an insolvency, bankruptcy, or receivership, personal information may also be transferred as a business asset. If another company acquires our company, business or assets, that company will also acquire and possess the personal information collected by us and will assume the rights and obligations regarding your personal information as described in this Policy.

SECTION 5 – PAYMENT PROCESSING

Our store is built on an e-commerce software platform called WooCommerce that allows us to sell our products and services to you.

Payment: If you provide us with your credit card information during the payment process, we send it to our PCI-DSS compliant payment gateway for processing using SSL encryption technology. 

All direct payment gateways comply with the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and our payment processors and service providers.

SECTION 6 – THIRD-PARTY SERVICES

Links: When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy policies.

SECTION 7 – SECURITY

To protect your personal information, we take reasonable precautions and follow generally accepted industry practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. Your personal information is protected by your password – never share this password with anyone. Empire Shopping Network will never contact you to ask you for your password.

If you provide us with your credit card information, the information is transmitted to our server using secure socket layer technology (SSL) which employs the AES-256 encryption standard.

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you consent to any of your minor dependents using this site.

Your rights with respect to your personal data

Right to request deletion of the data – Request to delete.  You can ask for the deletion of your personal information. If you ask us to delete your personal information, we will respect your request and delete your personal information, subject to certain exceptions provided by law, such as (but not limited to) the exercise by another consumer of his or her right to free speech, our compliance requirements resulting from a legal obligation or any processing that may be required to protect against illegal activities.

Right to be informed – Request to know.  Depending on the circumstances, you have a right to know:

  • whether we collect and use your personal information;
  • the categories of personal information that we collect;
  • the purposes for which the collected personal information is used;
  • whether we sell your personal information to third parties;
  • the categories of personal information that we sold or disclosed for a business purpose;

In accordance with applicable law, we are not obligated to provide or delete consumer information that is de-identified in response to a consumer request or to re-identify individual data to verify a consumer request.

Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights. We will not discriminate against you if you exercise your privacy rights.

Verification process.  Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with the information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g. phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. If, however, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity, and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

  • you may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the data
  • you can designate an authorized agent to make a request under the CCPA on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with the CCPA.
  • you may request to opt-out from future selling of your personal information to third parties. Upon receiving a request to opt-out, we will act upon the request as soon as feasibly possible, but no later than 15 days from the date of the request submission.
